Azerbaijan Airlines Flight Delays Compensation


Widely known as AZAL, Azerbaijan Airlines is the official airlines of the then state of Soviet Union. The main destinations of the airlines include Europe, Middle East and the rest of Asia. Every year, there are about 1 million people, more or less, who acquire the services of the airlines. On April 1992, AZAL was established so that the people of Soviet Union will have to obtain services which are different from Aeroflot. Azerbaijan Airlines owns about 30 Boeings, Embraers, and Airbuses. The usual destinations of AZAL include the United States, Europe, Asia, and CIS. Except for its airline services for the general public, the airlines also planned EMS and VIP transport through helicopters.

Subsidiaries and Alliances of the Azerbaijan Airlines

Azerbaijan Airlines have Azal Agro Air, Azal Helikopter and Azal Avia Cargo as its subsidiaries. On the other hand, AZAL is a subsidiary of Azerbaijan Hava Yollari, a joint stock company.

Code-Share Agreements

AZAL is in a code-share agreement with the following airlines: Qatar Airways, Ural Airlines, Austrian Airlines, Easter Airways, British Midland International, Turkish Airlines, Alitalia and Air France. However, AZAL is not only in a code-share agreement with these airlines but a lot more. These are only some of those airlines where AZAL has a code-share agreement.

EC Regulation 261/2004

On February 17, 2005, EC Regulation 261/ 2004 was passed. The regulation is applicable to those who are leaving through any airport from the European Union (EU) or any airport not in the EU but riding an EU airplane going to EU destinations.

It must be noted that there are certain rules to be followed for compensations during flight delays. No compensation shall be given in case the reasons for the cancellation or delay of a flight are unavoidable extraordinary circumstances such as terrible weather and pre-empted terrorist attack. In case the situations mentioned happens, no compensation may be given.

However, once a flight that have a distance of more or less 3500km is delayed for more than 4, a passenger may claim compensation as dictated by the regulation. Other flights where passengers are entitled to compensation are the following: 3 hours delay in an intra-community flight with a distance of 1500km or more and 2 hours delay in flights having a distance of 1500km or less. All these delays must not be caused by an extraordinary reason. In cases where the delay is for more than 5 hours already, the passenger has the right to cancel his flight and get reimbursement.

The guidelines for compensations for flights which are cancelled and delayed are the following:

1. For flights with a distance of 1500 km or less: 250 euros.
2. For flights with a distance of 1500 km up to 3500 km: 400 euros.
3. For flights with a distance of 3500 km: 600 euros.
