O'Hare Airport delayed / cancelled / overbooked flight problems

O'Hare Intl. Airport is one the busiest airport in the world. It carries more than 65 million passengers to worldwide destinations. According to flight delay statistics, Chicago flights are usually delayed by almost two to three hours on arrivals as well as at departures due to heavy passengers' traffic, cargo load, or for some other reasons.

If your flight delays on arrivals for more than 3 hours, or was cancelled without prior notice of at least 7 days, or you were denied boarding due to overbooked flight, then EC Regulation 261/2004 entitles you to claim compensation.

EC Regulation 261/2004 - Passenger Rights Regulation

EC Regulation 261/2004 (dated 17 February 2005) applies to air passengers departing from any EU airport, or from a non-EU airport with an EU airline to an EU destination. Passengers must note that flight compensation is subject to certain conditions and exceptions.

There will be no compensation for delays or cancellations caused due to extraordinary circumstances, under which such delays or cancellations becomes uncontrollable. An example of such situations includes, extreme bad weather, strikes or security concerns such as fear of a terror attack. In such situations, passengers are not eligible for compensation.

If you are an air passenger travelled from Chicago ORD Airport with an EU registered airlines or to Chicago with non-EU Airline, but departed from an EU airport, you are eligible for compensation.

If your flight was delayed on arrival for more than 3 hours, for reasons which could have been easily controlled by the airlines or was under control of respective authority, then according to EC Regulation 261/2004, passengers can receive compensation up to 600€.

This takes into account the distance that you travelled.

Within EU,

  • If you travel up to 1,500 km or less, then you can claim up to 250€
  • And over 1,500 km, you can claim up to 400€
